Carmex Lotion was discontinued in the US because of a lawsuit filed by the National Retail Federation (NRF) against Carmex.
The NRF filed a complaint against Carmex in federal court, claiming that the company violated the Lanham Act by falsely advertising its lip balm as being made with “carmine,” which is a trademarked name for the red dye used in food coloring. The NRF argued that Carmex could not use the term “carmine” because it had no right to use it under federal law because it was not a natural ingredient.
